MONAGHAN FARM TRAIL RUN

PARTICIPANT INDEMNITY, WAIVER AND ASSUMPTION OF RISK

 

By entering and/or participating in the Monaghan Farm Trail Run, organised by In-Reach Lifestyle at Monaghan Farm Estate, which includes optional trail runs of various distances, I hereby acknowledge, confirm and agree as follows:

 

I understand that participation in the trail run and related activities involves inherent risks, including but not limited to:

1. physical exertion and fatigue;
2. exposure to weather and natural elements;
3. uneven terrain and trail hazards;
4. presence of wild and/or domestic animals, including but not limited to snakes, scorpions, horses, warthogs and other animals;
5. potential illness, injury, accident or death.

 

I confirm that I am in good health and physically capable of participating. I voluntarily assume full responsibility for all risks associated with my participation.

I hereby waive and abandon, to the fullest extent permitted by law, any claim of whatsoever nature, whether arising in contract, delict, statute or otherwise, that I may have now or in future against In-Reach Lifestyle, Monaghan Farm Homeowners’ Association NPC, Clewer Development Trust, and their respective directors, members, trustees, officers, employees, contractors, agents, residents, volunteers, and all associated event sponsors and parties, collectively referred to as the “Indemnified Parties”, arising directly or indirectly from my participation in the event.

Without limiting the above, I specifically indemnify and hold harmless the Indemnified Parties from and against any loss, injury, illness, death, damage, liability or cost I may suffer or incur, howsoever arising, including but not limited to any claim resulting from:

1. the use of trails, roads or facilities;
2. contact with or attacks by animals or insects;
3. my own actions or omissions;
4. the actions or omissions of any other participant;
5. limited availability of immediate medical care, treatment or assistance due to the outdoor and trail-based nature of the event.

 

• I undertake to follow all instructions provided by In-Reach Lifestyle, Monaghan Farm personnel, marshals, medical personnel, security or event organisers.
• I acknowledge that participation is voluntary and at my own risk and discretion.
• This indemnity is binding upon me, my estate, heirs, dependants and assigns.
• I consent to photographs, video and other media taken during the event in which I may appear being used by In-Reach Lifestyle, Monaghan Farm, and the event sponsors and partners for event, marketing, promotional, publicity and social media purposes, without compensation.
• I consent to my personal information being collected and used for purposes related to the event, including registration, communication, timing, results, safety, medical assistance, emergency contact purposes, event administration and related event communication.
• I confirm that I have read and understood the content of this indemnity and accept it freely and voluntarily.
• By completing my entry, purchasing a ticket, accepting a ticket, or participating in the event, I acknowledge and agree that I am bound by this indemnity, waiver and assumption of risk as if I had signed it in writing.

MINORS AND GUARDIAN CONSENT

Applicable if the participant is under 18 years of age

 

Where the participant is under 18 years of age, I, the parent or legal guardian of the minor participant, hereby acknowledge, confirm and agree as follows:

• I consent to the minor’s participation in the event.
• I confirm that I am the parent/legal guardian of the minor and that I am legally authorised to provide this consent.
• I confirm that I have read and understood this indemnity and agree to be bound by its terms on behalf of myself and the minor.
• I assume full responsibility for all risks associated with the minor’s participation.
• I indemnify and hold harmless the Indemnified Parties against any claim arising from or related to the minor’s participation.
• I confirm that the minor is medically fit and physically capable of participating.
• I consent to emergency medical assistance, treatment or transport being arranged for the minor if reasonably required.
• By completing the entry, purchasing a ticket, accepting a ticket, or allowing the minor to participate in the event, I acknowledge and agree that I am bound by this indemnity, waiver and assumption of risk as if I had signed it in writing.
